And it came to pass in those days, that there went out a decree from Jorma Ollila that all the kilometers should be taxed.

The Finnish government planning a new road tax system, where each and every car is equipped with a GPS device which tracks all movements of the vehicle and then sends the information to the tax authorities who send a tax bill, which depends on how much and where you drive.

Herod the Great would have found it very convenient if the Roman client kingdom of Judea had had such a system for taxing donkey movements on the foot-paths of Palestine. Why?

After the known events in Bethlehem - including participation in a mandatory census, unsatisfactory boarding arrangements, childbirth, and a visit from three wise men who had come from far-away lands - Joseph and his family became asylum-seekers in Egypt:

The angel of the Lord appeareth to Joseph in a dream, saying, Arise, and take the young child and his mother, and flee into Egypt, and be thou there until I bring thee word: for Herod will seek the young child to destroy him.

And for a good reason:

Herod, when he saw that he was mocked of the wise men, was exceeding wroth, and sent forth, and slew all the children that were in Bethlehem, and in all the coasts thereof, from two years old and under, according to the time which he had diligently inquired of the wise men.

The European client state of Finland currently seems quite safe from such persecution. But we don't know that it will remain so. Given this, I think that the less mandatory information the government can collect about us, the better.

Road to hell is paved with good intentions. Sometimes I wonder if all those intentions are so good in the first place.

PS. Why is Jorma Ollila, of all people, leading a workgroup that makes such plans? I can think of two good reasons:
1) He is a board member of Shell. It would be bad for Shell if some country set a precedent of allowing electric cars to propagate, taking benefit from that they emit less pollution and therefore there is less need for taxing the emissions.
2) He is ex-CEO and stakeholder in Nokia. Nokia no longer knows how to do business, so they are trying to lobby laws that would force people to use stuff that Nokia could make.

Trust us, we know what we are doing!

The Finnish government plans a fancy car taxation system (for links, hat tip Road Pricing and Tundra Tabloids). Every vehicle would be equipped with a GPS tracking device, and people would be paying tax according to their driving history (time and location).

This is marketed as a "congestion tax" (so greenie hipsters in city centers clap their hands) and in practice, it will be used as a tax to collect money from those who have no other option (i.e. those who drive in places where there is no practical alternative). This is an overall problem of "environmental protection taxes": if the tax achieves its purpose (for instance, some emissions are reduced, as is happening with cars) the government notices that the tax revenue is decreasing, so some other, alternative tax has to be applied to the same people who are already used to paying the "environmental protection tax". The public expenses are currently only 57 % of GDP, and that is not nearly enough, as we can see because everyone is complaining about eroding services and declining tax base.

OK, so we have "congestion tax" data collected about people - where there is no congestion. The government says that the collected data will be used for taxation only, so there should be no concern about privacy. OK, so it might be used also for solving "severe crimes" (hey, who wants to help murderers?). And of course preventing "serious crimes" as well. And why not crimes in general? Don't worry about the privacy, the data will only be used for legitimate purposes.

And we definitely trust the government, don't we? They are entirely competent in protecting their own data networks, not to mention data of individual people that they are handling?

We need less fear and doubt

A few days ago, there was a small incident near where I live. An 8-year-old boy got lost and wandered around the area, went missing for the night - 12 hours - but was eventually found by searchers the next morning, unharmed but cold. He had just left his home in Helsinki riding a kickbike, didn't know where he ended up, and kept going through the night until he was found at 5 AM near where I live.

This was remarkable because it was not in the woods somewhere out in the forests - of which there are plenty in Finland - but the boy left off from Pitäjänmäki, a relatively dense urban/suburban area in western Helsinki; he wandered right through Leppävaara, an area with about 60 000 people living in the proximity, and ended up next to a major hospital.

How is this possible? It is a sad thought: a boy is lost in town. He walks past well-to-do suburbs, he passes a thousand front doors of homes. The night gets colder. He doesn't stop to knock or ring the doorbell at any one of them. Every single one of them would have, once opened, had people who would have realized that here is a child in distress, and people would have called immediately the boy's parents, offered him a mug of hot chocolate or whatever he needs, and if necessary, given him a ride home.

But the boy did not ring a doorbell. He just kept wandering in the wrong direction, for twelve hours, and his parents and relatives panicked. They called the police, search parties were arranged, the family patrolled the area, a helicopter was called to search. Why did the boy go on alone?

Perhaps he was a bit autistic or something similar, or just shy - not an unusual condition. That could explain this partially. But I think he was afraid. He has probably been told that he must not talk to strangers. Strangers could kidnap him. Strangers could molest or abuse him. Children are taught to avoid strangers.

But that is quite wrong. Almost all people, when they meet a child in distress, try to help. The kidnappers and other wrong-doers are really, really rare. But still children are taught to assume the worst of strangers. Even in extremely safe societies with strong social cohesion such as Finland.

That is so wrong. But unfortunately, we'll get more of the same. MLL (Mannerheim's Child Protection Association, a quango) wants every volunteer who deals with children to be vetted and background-checked and the Ministry of Justice agrees.

This is a bad, bad idea. It is already hard enough to get people to work for free for common good with things like sports clubs etc. If I have to pay and get a vetting license to prove that I am not a child molester in order to take my child's friends in my car to a football game, it's both an inconvenience and an insult.  I don't have to take it. It means I don't do this for the sports club. So we need more tax-funded workers to arrange things for the kids - when in reality, the biggest risk and problem is that there are not enough adults who do things with children, their own children and those of others.

There are occasionally cases where children are really abused. But vetting doesn't necessarily help. The most notorious of cases of violence against children was that of 8-year-old Eerika, who was tortured and eventually suffocated by her father and stepmother. How was it possible? It happened because the step-mother worked at the child protection services herself. The profession couldn't help because it  couldn't see wrong in one of its own. Wrapping up a child in a carpet was an approved method of therapy. Therapy which happened to kill the girl.

What we should do is not to have more vetting and bureaucracy and licenses. What we need is that people care, and speak out when they see trouble. We also need that people don't hesitate to care because they're afraid of misunderstandings. That they help a child who is lost, instead of thinking "this belongs to the authorities, and I could be perceived a potential child molester if I ask a kid whether he or she is all right".

So, we don't need more vetting. We need less fear and doubt.

Ministerial blundering with taxes

Recent headlines in Finnish news have been a bit like from a Mel Brooks movie. Heidi Hautala, a former MEP and a righteous, indignant Minister for International Development and State Ownership Steering Issues, who preaches to others against grey economy, is found out to have paid cash in hand, avoiding taxes when employing a craftsman and a cleaner. She had to leave a position in a cabinet working group against grey economy. It's a farce.

He was replaced by Ville Niinistö. Who then promptly is revealed to have been driving his ex-wive's car, registered in Sweden, without paying the car tax - avoiding the payment of a substantial sum. The car was stored in the Parliaments parking garage, against the practise which is that the lot is not for long-term storage. On top of that he decided to bury all the bad news in one go on the day of Boston Marathon bombing, and threw in a speeding ticket as well.

Hautala's case is a typical story where a very small misconduct is covered by little white lies that grow and eventually take over completely, bringing down the politician. Another similar case was the recent Huhne/Pryce case in U.K where a government minister resigned and went to jail (and got to the was bottom of the pile there) because of a little deception that started with a speeding ticket. and grew into perjury. The initial, almost negligible offence, and the consequences and amount of publicity, are quite out of scale.

In our modest Finnish case, Hautala was  exposed by an antagonised ex-employee. She first denied any real wrongdoing, then explained it is a misunderstanding, then blamed a conspiracy by Mr. Batman and his allies of the mysterious SAFKA, a tin-foil-hat "anti-fascist" organisation which mainly concentrates on finding absolutely nothing wrong with Putin's Russia (while Hautala quite justifiably finds a lot of wrong with Putin's Russia). We're waiting for the next phase with a large bucket of popcorn.

Hautala declares that "no one can afford to moralise". This is hardly convincing, because right until this point, she was moralising to everyone else as much as anyone was willing to listen.

So the situation definitely calls for a Hitler rant (click the little envelope icon for English subtitles; if you prefer Finnish burned-in texts, see this.)

Niinistö's behaviour is similar, likewise comical. His party is known to be hostile towards cars, and all for public transport. I know several supporters of the party who want very harsh punishment for those who are caught speeding. They are also intent on reducing parking spaces in Helsinki (and anywhere). But suddenly their chairman is found to be parking his car, which conveniently avoids annual car tax by being registered to Sweden, at the Parliament's garage, long-term, and speeding (in a rented Lexus) so much that a normal citizen would lose driving license instantly...

So we absolutely need another Hitler rant.

Pyöräilysäännöistä

Monet tuttavani ovat taivastelleet pyöräilysääntöjen monimutkaisuutta luettuaan Otso Kivekkään blogikirjoituksen Kuvitettu pikaopas risteyspyöräilyyn. Melko aktiivisena pyöräilijänä keskustelu hieman huvittaa minua. Vähänpä ovat ihmiset tiellä liikkuneet eri liikennevälineiden puikoissa! Tämä on nimittäin vasta alkua.

Erilaisia kombinaatioita saa toki tehtyä huomattavan paljon, kun luettelee tapaukset, joissa erityyppiset tiet kohtaavat, ja listaa kaikki mahdolliset parin ajoneuvon kulkusuunnat. Itse säännöt eivät kuitenkaan ole aivan näin monimutkaiset, niitä vain joutuu soveltamaan kaikissa mahdollisissa yhdistelmätilanteissa. Kivekkään esittämissä tapauksissa säännöt ovat kutakuinkin selviä.

Itseäni harmittaa em. risteystyyppejä enemmän se, että monista pyöräilyyn liittyvistä asioista ei säädetä kunnolla tieliikennelaissa eikä -asetuksessa. Lisäksi merkinnät ovat usein virheellisiä. Eikä ongelma rajoitu vain pyöräilyyn. Itse asiassa liikenteen lainsäädäntö on monin paikoin epälooginen ja puutteellinen. Lainsäätäjä ei ole saanut aikaiseksi määritelmiä edes yleisille tiejärjestelyille, kuten pyörätien jatkeelle tai liikenneympyrälle. Alla käsittelen muutamia joka päivä näkemiäni liikenneympäristön vikoja.


1. Ristiriitaiset tiemerkinnät

Pyörätie vai jalkakäytävä? Se riippuu!


Eräs tyypillinen polkupyöräväylien ristiriita aiheutuu siitä, että väylä on toiseen suuntaan merkitty pyörätieksi, toiseen suuntaan ei. Oheisessa kuvassa kotini läheltä on malliesimerkki. Tästä lähtee  etelästä pohjoiseen selvästi  kevyen liikenteen väylä eli yhdistetty pyörätie ja jalkakäytävä (merkki 423), joka vähän ajan kuluttua jatkuu asuntokadun vierellä ilman uusia merkintöjä.

Toiseen suuntaan pohjoisesta etelään tultaessa, lähimmässä risteyksessä liki puolen kilometrin päässä kuvaajan suuntaan, tiellä ei ole mitään kevyen liikenteen väylän merkkejä, vaan kyseessä onkin jalkakäytävä. Kiveykset ohjaavat kuitenkin selvästi pyöräilijää ajamaan tätä väylää, eikä siirtymään ajoradalle. Saako siinä ajaa pyörällä TLL 40 § mukaisesti ja pitääkö jalankulkijan kävellä väylän reunaa? Molempiin suuntiin vaiko ainoastaan siihen suuntaan joka on merkitty merkillä 423? Ja onko toiseen suuntaan kulkeva jalankulkija oikeutettu närkästykseen, kun hän mielestään kävelee jalkakäytävää, ja vastaan tulee pyöräilijä, jonka mielestä taas jalankulkijan tulisi kulkea väylän reunassa jotta siinä mahtuu pyöräilemään?

Sopu sijaa antaa, kun taas periaatteessa oikeassa olevat ihmiset saavat tästä aikaan riidan.


2. Ristiriitaiset tiemerkinnät

Kumpi merkintä pätee?


Kun liikennemerkki näyttää, että pyörien pitää ajaa vasemmalla, ja tiemerkintä näyttää että pitää ajaa oikealla, niin kumpi pätee, merkki vai tiemaalaus?

3. Olematon lainsäädäntö ja oikeuskäytäntö

Pyörätien jatke


Seuraava epäselvä asia on pyörätien jatke. Kuten sanottu, sitä ei ole määritelty tieliikennelaissa eikä -asetuksessa. Asetuksessa kerrotaan, kuinka jatke merkitään, mutta ei sitä, mitä se tarkoittaa, eikä sitä, missä tapauksissa jatke olemassa kun sitä ei ole merkitty.

Jatkeella voimassaolevia väistämissääntöjä käsittelee KKO:n ennakkopäätös KKO:1996:125, joka - hieman huvittavasti - huolellisesti välttää ottamasta kantaa siihen, oliko kyseinen paikka pyörätien jatke vai ei. Lainsäätäjä ei osaa säätää, eikä KKO halua päättää. Käräjä- ja hovioikeudessa oli vielä  rohkeasti otettu kantaa ja päädytty siihen, että kun toisella puolen katua on jalkakäytävä, niin pyörätie ei jatku suojatielläkään.

KKO siis vain toteaa, että toisen osapuolen - autoilija - näkemien liikennemerkkien mukaan suojatiellä se ei selvästikään ollut pyörätien jatketta. Pyöräilijältä ei kuitenkaan voi vaatia sitä, että hän näkisi tien toisella puolella olevan jalkakäytävän.merkin 421 vaan "B:n tulosuunnasta tarkasteltuna suojatien luonne on ollut epäselvä.". Siis nahkapäätös, ja kenellekään ei ole edes tullut mieleen korjata epäselvää lakia kuluneen 17 vuoden aikana.

4. Eri säännöt ristiriitaisten tiemerkintöjen mukaan

Pyörätie, vai tie jolla saa ajaa pyörällä?


Eräs mielenkiintoinen pyörätiekysymys on tien laatu silloin, kun se on joistain kohdin tielle tultaessa merkitty pyörätieksi (merkki 423, joskus harvoin 422) ja toista reittiä samalle tielle tultaessa se onkin tie, jolla on kielletty ajo moottorikäyttöisellä ajoneuvolla, mahdollisesti joillain poikkeuksilla (merkki 312, ehkä lisäkilpien kera). Tämä vaikuttaa pyörätien jatkeen sääntöihin sekä väistämissääntöihin: pyörätieltä suojatielle tultaessa kyseessä voi olla pyörätien jatke, mutta muulta tieltä tultaessa ei. Toisaalta taas pyörätietä muulle tielle tultaessa pyöräilijä on väistämisvelvollinen, mutta muuta ajorataa oikealta tuleva pyöräilijä ei ole - vaikka kyseessä olisikin tosiasiallisesti vain pyöräilijöille ja jalankulkijoille tarkoitettu tie.

Risteyksessä ajorataa kulkevan ajoneuvon kuljettaja ei tietenkään mitenkään voi tietää, mitä reittiä oikealta tuleva pyöräilijä on paikalle tullut: onko hän tullut pyörätietä, jolloin pyöräilijä on väistämisvelvollinen TLL 14 § 3 mom mukaan, vai muuta tietä, jolloin ajorataa kulkeva on väistämisvelvollinen TLL 14 § 1 mom mukaan.

Onko oikeanpuolisessa kuvassa oleva suojatie pyörätien jatke? Sitä ei ole sellaiseksi merkitty, mutta tästä ei asiaa voi päätellä.

Tällä puolen katua kulkee vasemmalta oikealle pyörätie. Toisella puolen tiellä ei ole mitään merkintää. Onko talon taakse lähtevä väylä pyörätie? Tällä tiedolla ei. Mutta.

Tie näyttää tästä katsoen pihatieltä, jollaista tarkoitetaan väistämisvelvollisuutta käsittelevässä TLL 14 § 3 mom:ssa. Toisesta suunnasta tielle pääsee kuitenkin paria eri haaraa. Yksi niistä on merkitty kevyen liikenteen väyläksi (merkki 423) ja toinen on tie, jolla moottoriajoneuvolla ajo on kielletty (merkki 312). Niinpä jotain reittiä talon takaa tuleva saa ajaa tästä suojatien yli (mutta on väistämisvelvollinen TLL 34 § 4 mom mukaan), toista reittiä paikalle tullut taas ei. Tältä puolelta vastarannalle pitää aina taluttaa. Käytännössä kukaan ei tietenkään taluta vaan kaikki ajavat pyöränsä yli.


5. Epäselvä lainsäädäntö ja merkinnät

Koskeeko liikennevalo pyöräilijää?


Normaalisti risteyksessä ajoradan liikennevalo koskee pyöräilijöitä, mikäli kevyelle liikenteelle ei ole omia valoja. Tämä on liikennesääntöjen perusteella selvää (TLA 22 §)

Ylemmässä kuvassa on ihan normaali tien ylittävä suojatie - siis pelkkä ajoradan ylittävä suojatie ilman risteävää ajorataa, onko se samalla suojatien jatke selviää käymällä kiertelemässä puolen kilometrin päässä - ja tien vieressä korokkeella erotetty kevyen liikenteen väylä. Jos valo vaihtuu punaiseksi, autot pysähtyvät. Pysähtyvätkö pyöräilijät? Eivät tietenkään.  Mutta TLA 22 § ja 25 § perusteella  pyöräilijöiden pitäisi pysähtyä, paitsi jos valo ei koske pyöräilijää siksi, että pyörätie on merkitty erikseen ja valo on pyörätien vasemmalla puolella, ainakin melkein.

Jolloin se on pyörätien oikealla puolella toiseen suuntaan ajettaessa. Tienpitäjän tarkoitus ei ole ollut, että tässä pysähdytään odottamaan valoja, tai taluttamaan.

Liikennevalo on suunnattu ajorataa kohti noin 15 asteen kulmassa. Tästä pyöräilijä päättelee, että valo ei koske häntä. Miten silloin menee väistämisvelvollisuus tietä ylittävien pyöräilijöiden ja tätä pyörätietä ajavien kesken? Alemmassa kuvassa tietä ylittävä tulee oikealta, joten pyörätietä ajava on väistämisvelvollinen. Ylemmän kuvan suuntaan ajettaessa taas vihreällä valolla suojatien jatketta ylittävä pyöräilijä on väistämistelvollinen.


6. Epäselvä lainsäädäntö ja puutteelliset tiemerkinnät

Onko tämä Mäkkylässä Turuntien ylittävä suojatie myös pyörätien jatke? Molemmilla puolin tietä kulkee yhdistetty kevyen liikenteen väylä, ja suojatie yhdistää ne. Minä en tiedä onko tämä pyörätien jatke, mutta pitäisin luonnollisempana, että kyseessä on pelkkä suojatie, koska suojatien suuntaisesti ei jatku pyörätietä kumpaankaan suuntaan eli se ei ole luontevasti "jatke" eikä sitä ole myöskään jatkeeksi merkitty.

Käytännössä kaikki pyörällä tietä ylittävät menevät tässä suojatien yli ajamalla, eivät taluttamalla.


7. Ristiriitaiset merkinnät

Pyörätien jatke: lähteekö tästä pyörätie?


Tässä suojatielle on selvästi merkitty pyörätien jatke, mutta sen jälkeen ole mitään liikennemerkkiä. Suojatien takaa siis alkaa jälkakäytävä, ja pyöräilijän pitäisi siirtyä pyörätien jatkeelta ajoradalle.... paitsi että ei sittenkään. Toisesta suunnasta samalla osuudella on kyllä merkki 423.



Toisin sanoen kyseessä on merkintävirhe, ja tästä saa jatkaa pyörällä. Se vain pitää tietää, ylemmässä kuvassa olevan ajosuunnan merkeistä sitä ei näe.


8. Epäselvä lainsäädäntö ja merkinnät

Väistämisvelvollisuus: ketä väistät?



Tämä oli kompakysymys. Vastaan tulee pyörällä nainen ja lapsi, ja heihin ei saa törmätä, mutta siinä ei ole kyse varsinaisesti väistämisvelvollisuudesta. Kuvassa näkyvä kolmio ei myöskään aiheuta pyöräilijälle väistämisvelvollisuutta, vaan se on osoitettu ajoradalla liikenneympyrästä poistuville. Mutta oikealla on pyörätie, josta tulevaa toista pyöräilijää pitää väistää. Häntä vain ei näe tästä, hän on näköesteen takana piilossa.

Tällä esimerkillä tuon esille hyvin tavallisen ongelman kevyen liikenteen väylillä: väistämisvelvollisuudet risteyksissä autoteiden kanssa on kyllä merkitty suhteellisen hyvin, mutta pyöräteiden risteyksissä väistämisvelvollisuuksia merkitään aniharvoin. Ne ovat tasa-arvoisia risteyksiä. Seurauksena on se, että isoa tietä oikealta tulevilla  pyöräilijöillä on kolmiot, mutta pieniä polkuja tulevilla ei, ja siksi heitä pitää väistää. Kun polkuja ei ole edes mitenkään merkitty, tämä rajoittaa toisinaan pyöräilijän etenemistä, koska pitää varoa pikkupolkuja, joista ei juuri koskaan tule ketään.

Polkupyöräsäännöstö kevyen liikenteen väylillä on kaiken kaikkiaan selvästikin suunniteltu sillä ajatuksella, että kyseessä on lasten, vanhusten ja muuten vain vajaakuntoisten hidasta ja leppoisaa kulkemista, eikä polkupyörä ole ns. aktiiviväestön liikkumisväline paikasta A paikkaan B.


9. Puuttuva lainsäädäntö

Liikenneympyrä


Liikenneympyröitä on rakennettu noin viidentoista viime vuoden aikana paljon. Ne tuntuvat myös toimivan suhteellisen hyvin, koska vakavia onnettomuuksia sattuu niissä melko vähän. Ympyräbuumi on kuitenkin sikäli omituinen, että niitä vain ryhdyttiin tekemään, vaikka lainsäädäntö ei sano ympyröistä oikeastaan mitään. Tieliikennelaki ei tunne liikenneympyrää lainkaan. Tieliikenneasetus mainitsee ympyrät vain liikennemerkkien 166, 231, 232, ja 416 kohdalla eli kertoo että liikenneympyrän varoitusmerkki varoittaa liikenneympyrästä ja kiertosuunnan merkki kertoo kiertosuunnasta. Kiertosuunta on Suomessa aina vastapäivään, Swindonin taikaympyrän kaltaisia ei täällä ole, joten ko. merkin lisäarvo on kyseenalainen. Ja kärkikolmio on kärkikolmio ja STOP-merkki velvoittaa pysähtymään. No entä sitten?

Esimerkiksi Liikenneturvan oppaat ja Polkypyöräwikin liikennesääntösivu samoin kuin muutamat muutkin lähteet kirjoittavat, että liikenneympyrästä poistuva on risteyksessä oikealle kääntyvä ja siksi väistää ympyrän vieressä olevalla pyörätiellä ajavia pyöräilijöitä.. Tämä "sääntö" ei kuitenkaan perustu lakiin. Missään laissa, asetuksessa tai määräyksessä ei sanota, että liikenneympyrästä poistuva on määritelmän mukaan kääntyjä, etenkään silloin kun ajoneuvo ei tosiasiallisesti käänny - ja ympäristössä on tosiaankin runsaasti liikenneympyröitä, joissa suora ajolinja poistuu ympyrästä ja ympyrässä pysyäkseen on käännyttävä, joskus jyrkästikin. Jos ajat oikealla olevasta risteyksestä suoraan, niin käännytkö? Tuskinpa.


Entä käännytkö tässä liikenneympyrässä? No et tosiaan. Kuvassa näkyvä bussikin ajaa taatusti kaikkien mielestä suoraan, ei käänny eikä vilkuttele ympyrästä poistuakseen.

Ympyrästä poistuvan  väistämisvelvollisuus pyöräilijöitä kohtaan ei selvästi myöskään tienpitäjän mielestä perustu kääntyjäsääntöön, koska ne pyritään säännönmukaisesti merkitsemään kärkikolmioilla (merkki 231).


Aiheesta ei löydy ylempien oikeusasteiden  ennakkopäätöksiä. Eräs käräjäoikeuden päätös ilmeisesti jäi lainvoimaiseksi. Siinä iäkäs polkupyöräilijä törmäsi ympyrästä poistuvaan autoon ja kuoli. Käräjäoikeus totesi säännöt epäselviksi ja jätti autoilijan tuomitsematta liikenteen vaarantamisesta ja kuolemantuottamuksesta, perustellen päätöstä seuraavasti: Suomen perustuslain 8 §, Euroopan neuvoston ihmisoikeussopimuksen 7 artiklan 1. kappale ja kansalaisoikeuksia ja poliittisia oikeuksia koskevan kansainvälisen yleissopimuksen 15 artiklan 1 kappale edellyttävät rangaistavaksi säädetyltä teolta sitä, että se on tekohetkellä rangaistava ja että rangaistavuus on määrätyllä tavalla selkeä. Sanotuista säädöksistä ilmenee, ettei tuomioistuin saa mennä tunnusmerkistön ulkopuolelle. Säädöksistä ilmenee myös se periaate, että mikäli rikoslainsäädännön alalla on aukkoja, niitä ei voida paikata hallintoviranomaisten toimenpiteillä.

"Kääntymissääntöä" perustellaan usein sillä, että liikenneympyrä on erillinen tie, joten totta kai siltä poistuva kääntyy, ja pitää näyttää vilkkua ja väistää pyöräilijöitä. Mutta jos näin on, niin myös ympyrään tultaessa pitäisi TLL 35 § mukaan näyttää vilkkua, sillä yksisuuntaiselle tiellekin pakolliseen kääntymissuuntaan käännyttäessä suuntamerkki on pakko näyttää. Näin ollen Liikenneturvan liikenneympyräohjeet ovat ristiriidassa TLL:n kanssa. Ne voivat olla ihan hyvät ohjeet ja voisivat olla hyvä sisältö laille, mutta nyt ne eivät perustu lakiin. "Väärästä" vilkuttamisesta sakot saavan kannattaa riitauttaa rangaistus lakiin perustumattomana.

Silloin, kun ympyrästä poistuvalle on kolmio, väistämissäännöt ovat tietysti aivan selvät vaikka suuntamerkkisäännöt eivät olekaan. Tienpitäjälle on vain haasteellista merkitä väistämisvelvollisuudet riittävän selvästi, ja korjata auraajien, ilkivallan jne. tuhoamat merkit.

Liikenneministeriön kannattaisi herätä ja korjata tieliikennelaki. Nyt siellä on kyllä hyvinkin paljon detaljeja  ajopiirturikorttien myöntämisprosessista ja muusta vastaavasta ammattiliikenteen sosiaalilainsäädännöstä, mutta tavallisia ja yleistyviä liikennejärjestelyjä ei käsitellä lainkaan.


10. Puutteellinen lainsäädäntö


Kun seuraa päätietä, onko kääntyminen kääntymistä?

Oheisessa kuvassa näkyy melko tavallinen tilanne, jossa päätie kääntyy oikealle ja suoraan jatkuu pienempi sivutie. Kuva on otettu Vanhaa Turuntietä pitkin idästä päin Vanhan Tienhaaran risteykseen. Sivutieltä eli kuvassa edestäpäin Vanhaa Turuntietä lännestä tuleville ajoneuvoille on kärkikolmio 231 ja siinä lisäkilpi 863. Paikkaa voi tarkastella Google Streetviewssä.

Idästä tuleva polkupyöräilijä seuraa tätä pääreittiä kuvassa näkyvää tien vasemmalla puolella olevaa kevyen liikenteen väylää (Vanha Turuntie), joka siis kääntyy tässä oikealle (Vanha Tienhaara). Pyöräilijä saa ajaa pääväylän suuntaan suojatietä, koska se on suojatien jatke. Jatketta ei ole  merkitty tiemerkinnällä, mutta vastakkaisen suunnan lisäkilvestä 863  voi päätellä että jatke se on.

Mutta mistä voi tämän tietää autoilija, joka ajaa pyöräilijän kanssa samansuuntaisesti länteen, ja haluaa tässä ajaa suoraan eli poistua pääreitiltä, pysyen Vanhalla Turuntiellä? Kärkikolmiotakaan ei ole kovin helppo havaita (näetkö sen itse kuvassa?) ja lisäkilpeä ei ole tietenkään mitään mahdollisuutta nähdä. Polkupyöräilijät näyttävät suuntamerkkejä hyvin satunnaisesti, niin satunnaisesti että autoilijat eivät näytä uskovan silmiään kun sellaisen näkevät.

Kun pyöräilijä seuraa päätietä (tosiasiassa kääntyy oikealle) mutta autoilija poistuu siltä (tosiasiassa ajaa suoraan), niin kumpi on väistämisvelvollinen? Koska auto ei käänny ja pyöräilijä kääntyy, TLL 14 § ei oikein ole voimassa. Paitsi jos merkityn etuajo-oikeuden mukaisesti tulkitaan, että pääreitiltä poistuva kääntyy, vaikka ajaakin suoraan, ja pääreittiä ajava ajaa suoraan, vaikka kääntyykin. Entä sitten, kun pääajolinjan merkintä tiehen on lumen peitossa?

En tiedä, kuka on tässä väistämisvelvollinen. Tietääkö joku? Lainsäätäjä? Liikenneministeriö? Liikenneturva? Poliisi? Esko Riihelä? Jurvan ent. kunta?



Lopuksi


Kaikissa ylläolevissa paikoissa on mahdollisuus liikenteen konfliktitilanteeseen. Mutta kuitenkin: jos en laske punaisia päin käveleviä jalankulkijoita, kaikkein tavallisin näkemäni liikennesääntöjen väistämisvelvollisuudesta poikkeaminen on  se, että autoilija pysähtyy kohteliaasti antamaan pyöräilijälle tietä, vaikka olisi väistämisvelvollinen. Niin käy minulle lähes joka päivä. Edes tavallisin vaaratilanne, oikealle kääntyvä auto joka ei huomaa risteyksessä pyörätietä suoraan ajavaa pyörää, ei ole läheskään niin tavallinen - siihen joutuu vain ehkä viikoittain. Liikenne siis sujuu kuitenkin varsin mukavasti. Olisi kuitenkin hyvä, että edellämainitut puutteet korjattaisiin lainsäädännössä ja tiemerkinnöissä.

No-death cars

News is that Volvo is developing 'no-death cars'. I.e. vehicles in which no one can be killed.

With some irony, we can note that these cars ought to be very popular
a) in Afghanistan (to replace tanks which are vulnerable to giant IEDs)
b) in use by criminals, who are otherwise gunning each other down
c) among senior citizens, considering that a substantial part of Finnish road deaths are actually just deaths on the road, i.e. old and sick people who die of a heart attack or other illness - the deaths are still counted as traffic deaths, because the traffic death numbers need to be inflated to justify taxation.

Most importantly, the cars should be used in hospitals, as replacements for emergency rooms. If the patients cannot die there, it will be a significant improvement for hospital performance.


This month's Moottori (3/2013) tells us that there were 21 road deaths in March 2012. One of them was a pedestrian (who stepped in front of a truck on a highway, from behind his car). Ten of them were killed by illnesses or seizures, not really any accidents. In some of these traffic deaths, the driver just died and the car stopped, without being damaged. A "zero vision" in road deaths will have to change its base of statistics some day.

Eleven days of autumn, and world hunger

In September 1752, Britain and her dominions adopted the Gregorian calendar. Wednesday, 2nd of September was followed by Thursday, 14th of September. This is a piece of trivia nowadays known to most Unix geeks and not known to most humans.

A legend says that this resulted in riots: uneducated people thought that the King and his government had stolen away eleven days of their lives. They supposedly thought that even though their date of expiry is not known, it is predestined, in the calendar. They should be compensated for having their frightful day brought closer by more than a week!

Of course, the legend is not really true. Everyone knew the change was just about fixing the old Julian calendar which was getting badly out of sync with stardates. Catholic countries had switched already in 1582, but Anglicans had hated to do the same, because it would mean admitting that the cursed Papists could be right about something. The threat of counter-reformation gone, it was time to change.

Sweden had decided to do it gradually in the leap years after 1700, in a way that reminds us of the imaginary 1969 plan to move from left-hand  to right-hand traffic gradually first week only trucks change to right side and everyone else drives as before, then the following week buses switch, and private cars only a few weeks later, after professionals have deemed it is safe to do a complete switch-over. It didn't work out too well.

Russia never really got there, which is why the October Revolution was in November 1917 and nowadays, Finnish spas eagerly expect the Epiphany, which is when the Russian Christmas tourists arrive.

I'm reminded of all this by yesterday's paper which had yesterday's news: a fashionable world-traveler of reality TV fame Riku Rantala explains how world hunger is caused by market speculants. "American bankers" are "playing a casino game" where "speculators" are causing shortages and raising prices and "leeching off the poor". The piece would almost make a good parody, but I am sure it has been written quite earnestly.

It's very fashionable to blame Americans, the "bankers" and "libertarists" for all kinds of evil, but the article fails to explain one thing: what happens to the food that these speculators are hoarding and not selling to the poor people of the world? What do they do with the food whose price has gone up and and which they refuse to sell? How do they stop it from going to consumption? Are they storing it up somewhere, so that there is peta-sized rice vault in the style of Uncle Scrooge McDuck's money bin, big enough for ocean-going ships to swim in? One that holds all the food the poor of the world are not getting? Where is that immensely vast storage, and what do the bankers plan to do with it eventually?

There's no hoard. The food doesn't disappear any more than the eleven days of autumn 1752 disappeared in England. Of course, there are reserves of food all over the world, owned and maintained by governments, private companies and individuals. But there's no great hamster's nest full of food that could be used to feed the starving masses of Third World. The food is traded and spent by the markets, just like the days of one autumn 260 years ago were spent by people of Britain and the colonies the calender change may have changed some things, like lengths of contracts for rentals or indentured servitude, but that doesn't change the big picture.

With food, the global picture says there is enough food in the world. And the situation has been improving rather than worsening. Yes, there's insufficient delivery somewhere, and insufficient purchasing power for many, and there are really poor people. But this is not because someone is stocking up.

Some hunger is caused accidentally by disasters and conflicts. Some is intentionally caused by wars, boycotts and other actions of governments and government-like entities. But most of world hunger is just life as it has always been for most of mankind.

In the First World, our perception of poverty is skewed because we are told  and we willingly believe that there are lots of absolutely poor people in our own country, and  then on our holiday trips in the Third World we stumble at the reality of life there. Back-breaking, mind-numbing absolute poverty, entirely different from what we're used to seeing but the kind of life that has been the norm for almost all throughout the history of mankind. That poverty is not an anomaly; it's what used to be the rule.

Look at the men in this picture. They are old men. They're carrying gravel up the hill to a temple in Sichuan, to be used in construction. Perhaps 50 kilos in a wicker basket on their backs, probably more than their own weight. They carry that from a depot up to the temple, perhaps five tours a day,  three kilometers away and 300 meters up. All day. That's how they make their living. And they are content, I think: they get so much rice that they have lived much longer than their fathers, many of whom perished in the famines caused by the Great Leap Forward where speculants surely were given what's their due. And everyone else as well was given what was their due, most obviously the peasants who had to pay their taxes even if that left them with nothing but their children to eat, in true Jonathan Swift style. If you didn't grow enough to pay your taxes, you obviously were hoarding up, a speculant, and there you are.

Riku Rantala says that food price rises are not due to climate change, biofuels or population growth.

This already should tell us that we're dealing with statements of religion, not outcome of research. For it is clear that hunger, like content, is the result of many things. And so is the price of food. There is no single reason to any famine, and no single factor determines price of food. In global perspective, demand for corn and palm seed oil for biofuel production certainly has raised the prices of these food materials, and when you have more people a growing population that is coming out of poverty and is eating better than ever then it is obvious that demand for food increases and the price increases.

Remember the 1985 Live Aid, which collected money to send food to those starving in Ethiopia? Thousands of tons of food was sent and it stayed rotting in ports of Ethiopia, because much of the whole thing was pointless. The famine was not really caused by lack of food in the country. It was primarily caused by the Ethiopian government forcibly relocating people. Even a Guardian reader should know that: the food aid may actually have helped enforce these relocations. Allowing delivery of the aid food to those who were starving would have undermined the political goals of the forced relocations, so much of the Live Aid was not delivered. Some of it was used by the very government that caused the famine in the first place.

The rise in prices is not primarily due to speculants, and they are not making any extraordinary profits by depriving people of their food. What are they doing then, why do they get such huge profits and how?

They are making extraordinary profits by giving world information it needs to know, and it is paid by those who want to know.

Why is the monetary price of food increasing? Biggest reason is that world poverty is decreasing so rapidly. Many more people than ever are earning more than a dollar a day. They are moving from nomadic or peasant style subsistence farming to more modern agriculture. They are moving from farms to cities to work in factories.

The figure on the right is from the World Bank: proportion of people in world living in extreme poverty. And remember: this is despite of considerable population growth. As an example, the population of Ethiopia, our postcard example of famines, has had its population grow from 38 million (1980) to 84 million (2012).

So, like no one lost eleven days of their lives because of the calendar change in 1752, no food disappears from the world because of futures trading. Rather to the contrary: trading in futures gives information to the producers which allows them to adjust their production. How?

What if global food speculators see that the percentage of farmland of a large producer country  allocated to corn will be increased from 7 % to 10 % next year, and wheat will decline almost correspondingly, because corn to be used as biofuel source will be giving a better price than wheat which is to be eaten? The speculator of course sees that it's good to buy futures for wheat.

What is the impact? With increasing demand, the price of wheat futures goes up, and this is a signal for producers that it may be profitable to increase wheat production, because next year someone will be paying a better price. For increasing production, many different ways are possible: allocate more land from something else, purchase or claim more farmland, or invest in more efficient farming methods and tools, develop crops etc. Producers adopt all of these.

So, the price increase in food does not really go to the pockets of speculators. Where do the huge profits of speculators come from then? Not primarily from the farmers, or the buyers, even if Riku Rantala would have you believe so. They come from other speculators. Some of them win, some of them lose. In this way Rantala is right, it is a bit like a casino game where people and institutions place bets about food price. But it is a casino game that produces useful information to the world, and thereby reduces famines, instead of increasing them. Of course, the speculation also has a cost: it is a cost of producing information. But the cost of speculation has no significant impact on food prices: the volumes of food trade are so huge. And what actually causes bubbles is regulation of speculation. That you distort the rules to reach a short-term political goal, usually by piling up more snow in  front of you to shovel.

Of course, some of the increase in purchasing power of people has negative impacts on availability of food. For instance, if more people are able to buy tobacco, chocolate or other luxury items, then this may allocate resources to farming these, and not food items.

Anyway, in the short term, speculation can indeed rise prices. This is a good thing because it helps to react to changes in the world so that in the long term, prices are more stable.And for world population, long-term sustainability of food production is what matters, not the short term. Instead of a sharp price increase in a year or two, we have price increase - some volatility - right now, which encourages producers to react and prevent food shortage and high volatility in the future.

We don't have to like the speculators, but just like the newspaper deliveryman, they give us something we should know. Sometimes it is rubbish, of course. Speculators can go wrong. But they do so with the very best effort they can make.

And the speculators are better paid than deliverymen are but earning a lot requires luck and skill. Anybody can try. For me, it's too hard work. So I just stand back to marvel at that "cal 9 1752" whenever I have trouble with the calendar being too full: it's wonderful that I don't need to look at the SAP reports every 20 days.
